To your first question, yes it will stand up when it has fluids in it. As to the second question - well, kind of! It takes a little getting used to before you can drink without sloshing the contents all over your hand at the very least! That's the way it was for me anyway. You just have to remember to hold the rigid plastic ring in the center and not very pliable, foldable silicone elsewhere on the cup.
