The state of NY has passed laws that prevent the importation of human pepper sprays. Animal rated pepper sprays can still be imported, the last time I checked. NY apparently cares more about protecting humans from animals than humans from humans. Importation of pepper spray is legal in most states surrounding NY.

Q: can the top come off by accident, such as being in a purse and the top falling off? Or is the top secure, and will not come off unless manually pulled

I've had the pepper spray in my purse for over a year and the top has not come off accidentally or otherwise. The top is secure, and will not come off unless manually pulled.
